Respondents Prayer: Criminal Original petition is filed under Section 482 of Criminal Procedure Code, to direct the second respondent herein not to harass the petitioner based on the complaint of Ponnuthai in the Civil issue pertaining to petitioner's vacant site property situated in ward No.2, T.S.No.403, measuring an extent of 0.00725 ares in Mela Avarampatti, Bharathiyar Street, Rajapalayam Town & Taluk, Virudhunagar District.

ORDER

This Criminal Original Petition has been filed by the petitioner, to direct the second respondent not to harass the petitioner under the guise of the enquiry, based on the complaint given by the third respondent.

2.The learned counsel appearing for the petitioner has submitted that the third respondent herein has filed a suit in O.S.No.1102 of 2004, on the file of the Principal District Munsif Court, Srivilliputhur for bare injunction and the said suit was dismissed. As against the said dismissal, she has filed an appeal in A.S.No.64 of 2014, on the file of the Sub Court, Srivilliputhur and the same has also been dismissed and now she gave a false complaint against the petitioner and based on the said complaint, https://hcservices.ecourts.gov.in/hcservices/

the second respondent is harassing the petitioner. 3.The learned Government Advocate (Crl.Side) has submitted that after receipt of the complaint from the third respondent, an enquiry has been conducted and after enquiry the same was closed as the dispute is Civil in nature and hence, the question of harassing the petitioner does not arise.

4.Recording the aforesaid submissions, this Criminal Original Petition is disposed of.
