O R D E R
This writ petition has been filed challenging the impugned notice issued by the fourth respondent in his proceedings in Na.Ka.No.1/25, dated 01.12.2025, and the consequential impugned notice issued by the fourth respondent in his proceedings in Na.Ka.No.4/25, dated 19.12.2025.

The learned counsel appearing for the petitioner would submit that, in the present case, disciplinary proceedings were initially initiated against the petitioner on 22.08.2025 by the third respondent, which were subsequently withdrawn by the same officer on 12.11.2025. Under such circumstances, the present impugned notices came to be issued by the fourth respondent. The petitioner has submitted his replies to the said notices on 04.12.2025 and 11.12.2025 respectively. Despite the same, the 2/6
fourth respondent proceeded to issue a notice fixing an enquiry on 20.01.2026 at 11.00 a.m. Hence, the petitioner has approached this Court by filing the present writ petition.

The learned Special Government Pleader appearing for respondent Nos.1 to 3 would submit that disciplinary proceedings were earlier initiated against the petitioner and the same were withdrawn by the third respondent. Thereafter, the fourth respondent issued the impugned notices. It is further submitted that the petitioner is at liberty to participate in the enquiry and that, based on the explanation already submitted by the petitioner, appropriate orders would be passed in accordance with law.

Considering the submissions made on either side and taking note of the fact that the petitioner has already submitted his replies, this Court is of the view that it would be appropriate to permit the petitioner to participate in the enquiry proceedings and place all relevant materials and documents, if any, in support of his case. 3/6

Accordingly, this writ petition is disposed of with a direction to the petitioner to appear before the authorities concerned and make his submissions, along with supporting documents, if any, to establish his case. Liberty is granted to the petitioner to submit any further explanation, if necessary.
6. Since the enquiry was originally fixed on 20.01.2026, the authorities concerned are directed to refix the enquiry on 28.01.2026. The petitioner shall participate in the enquiry on the said date without fail. The fourth respondent is directed to pass final orders on merits and in accordance with law, after affording due opportunity to the petitioner. No costs.
