PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the entire records connected with the Impugned Order passed by the third respondent in Na.Ka.No.4838/Aa1/2013 dated 21.03.2013 fixing the staff strength to the petitioner school and quash the same. For Petitioner : Mr.K.K.Kannan For Respondents : Mr.V.Nirmal Kumar Government advocate COMMON ORDER The present writ petitions have been filed by different schools challenging an order passed by the third respondent herein, fixing the staff strength for the respective schools for the academic year 2012-13. The said staff fixation order is under challenge on the ground that the teachers have been erroneously rendered surplus for various subjects.
2. The staff fixation is for the academic year 2012-13. Thereafter, every year the third respondent is continuously passing orders fixing the staff strength either reducing it or increasing the strength. Hence, the present impugned orders have been superseded in the subsequent years. Even, if the writ petition is allowed, the petitioner schools cannot be put 2/4
back to the original position of the year 2012-13. In such circumstances, nothing survives to be adjudicated in the present writ petitions. These Writ petitions are disposed of. However, the petitioners schools are at liberty to challenge the staff fixation order for the current academic year, if they are aggrieved. No costs. Consequently, connected Miscellaneous Petitions are closed.
