ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehending arrest at the hands of the respondent Police for the offences punishable under Sections 380(2) of IPC, in Crime No.Not known of Known of 2017, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is alleged to have involved in the theft of idol belonging to the Tharugavaneswarar Temple situated at Trichy. Thus, on complaint, a case has been registered against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the investigation of the case is under progress.

5. The submissions made by the learned counsel appearing on either side are considered.

6. It is alleged, during the time of occurrence, in the year 2014, the antique idol was replaced by some authorities and now, the idol made by them was kept in the place instead of antique idol. Thereafter, only on 12.06.2017, the petitioner herein lodged a complaint before the respondent Police, in which, he mentioned that the actual idol was stolen away from the temple. Now, according to the prosecution, they suspected the petitioner and the enquiry is proceeded.

7. Even though the case has not been registered against the petitioner, considering the gravity of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
