ORDER

This writ petition has been filed for a mandamus to direct the respondent to register and release the sale deed date 05.01.2026 kept pending in Document No.11/2026 forthwith on the basis of petitioner's representation dated 06.01.2026 within a time frame as fixed by this Court.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondent. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

3. The petitioner's grievance is that she has purchased the property for valid consideration and the sale deed was presented for registration. However, without registering the same, the same was kept pending as Document No.11/2026. When she approached the respondent, it is informed that there is undervaluation and therefore,the respondent is not in a position to register the same and hence, the petitioner has given a representation dated 06.01.2026. Since the said representation was not 2/5

considered so far, she is before this court.

The learned counsel for the petitioner would submit that the right course which is to be adopted by the respondent is to register the document and release the same and thereafter refer the same to the authorities under Section 47A of the Stamp Act. However without adopting such legal procedure, the authorities are keeping the document as pending.

The learned Special Government Pleader appearing for the respondent however, on instructions, would submit that in the event of undervaluation, the document would be registered and released and subsequently, the matter would be referred to the appropriate authority under Section 47A of the Stamp Act.

6. I have considered the rival submissions and perused the materials available on record.

Considering the submissions made on either side, since the document is pending on the ground of undervaluation, the respondent is directed to register the sale deed dated 05.01.2026 and if there is any undervaluation, it is open to the respondent to invoke the provisions of Section 47A of the Stamp Act and refer the matter for fixing the appropriate valuation in accordance with law.

8. The writ petition stands disposed of with the aforesaid direction. No costs.
