The petitioners are accused in Crime No.813 of 2023 on the file of the second respondent police. The said case was registered for the offence under Sections 147, 341, 294(b), 323, 324, 506(ii) and 379 of IPC and Sections 3(1)(r), 3(1)(s) and 3(2)(va) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 2015.
2.The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that the defacto complainant has filed a Public Interest Litigation against one Kousalya who is the Panchayat President of his village. The said Kousalya along with husband/first petitioner herein asked the defacto complainant to withdraw the case. But the defacto complainant refused to withdraw the case. On 09.12.2023, due to previous enmity, the petitioners assaulted the defacto complainant with stick, abused 2/4
in filthy language and also threatened him. Also, the learned Government Advocate (Crl. Side) further submitted that the injured has been discharged from the hospital on 13.12.2023.
3.The learned Counsel for the petitioners submitted that the petitioners have been falsely implicated in this case with an ulterior motive. 4.Considering the nature of allegation, this Court is not inclined to grant any relief to the petitioners as prayed for. Accordingly, this Criminal Original Petition is dismissed.
