ORDER

The present writ petition has been filed seeking a mandamus forbearing the respondents 4 and 5 to put up Assembly of Benefits or Welfare Hall, Crematorium and put up Cement Road in Survey No.90/B, 90/1B at Mukkoodal Cheranmahadevi Taluk, Tirunelveli District. 2.As per counter filed by the respondents, they are not putting up any crematorium in Survey Nos.90/B and 90/1B. However, they have put up crematorium only in Survey No.90B/1B and 90B/2B of Mukkoodal Village. Paragraph No.(vii) of the counter is extracted as follows: "vii).But the petitioner herein has come out with the present writ petition by claiming that the land belonged to her grandmother Tmt.Isakkiammal. But the land indicated by the petitioner is in S.No.90/B and 90/1B, whereas the work relating to construction of Gasifier Crematorium is only in S.No.90B/1B and 90B/2B of Mukkoodal Village. Hence, there is no connection whatsoever in the claim of the petitioner as the area wherein the work is taken up is entirely different and furthermore the name of Isakkiammal or Parvathy is not found in the revenue records. 2/5

Hence, the petitioner herein is not entitled for the discretionary relief of this Court much less the relief of Mandamus sought which is liable for dismissal at the threshold." 3.In view of the fact that the petitioner's land has not been disturbed, no further orders are called for.
