PETITION FOR modification Under Sec.439 of Cr.P.C PRAYER :- To modify the condition imposed on the petitioner in Crl OP(MD) No.7055 of 2019 dated 04.06.2019.
ORDER : The Court Made the following order :- The petition has been filed to modify the condition imposed on the petitioner in CRL OP(MD) No.7055 of 2019.
2. The learned counsel for the petitioner has submitted that this Court granted bail to the petitioner on 04.06.2019 with condition that the petitioner should appear before the respondent police daily at 10.00 a.m for a period of one month. He would further submit that the petitioner is complying with the conditions imposed by this Court since 07.06.2019 without any deviation. He would further submit that the petitioner is suffering from Acid Peptic Disease and he is unable to travel from Tiruchendur to Thoothukudi. Hence he prays to modify the condition imposed by the Court.

3. The learned Government Advocate(Crl.Side) would submit that this Court has granted bail to the petitioner on 04.06.2019 with condition that the petitioner should appear before the respondent police daily at 10.00 a.m for a period of one month and he has complied the condition only for 17 days only. Hence she opposed to modify the said condition.
4.Considering the facts and circumstances of the case, and also considering the fact that the petitioner has complied the condition only for 17 days, this Court is not inclined to relax the Condition.
5. Hence this petition is dismissed.
