PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- To pass an order permit the petitioner to implead in the Crl.OP (MD)No.8223 of 2019 as a 2nd respondent before Honourable Court. ORDER : The Court Made the following order :- This petition has been filed by the petitioner seeking permission of the Court to permit the petitioner to get impleaded himself as second respondent in Crl.O.P.(MD).No.8233 of 2019. 2.Ms.A.Rajini, learned counsel appearing for the petitioner in Crl.M.P.(MD).No.5577 of 2019 relying upon the decision in the State represented by the Inspector of Police VS. Tr.Nakkeeran Gopal reported in 2019 (1) CTC 497 contended that the the petitioner is entitled to proceed in the above proceedings. In the said decision, the learned Magistrate himself has volutarily asked Mr.N.Ram, the Chairman of Hindu Publications to give opinion as to whether there are any previous instances, where Section 124 of I.P.C has been invoked against the media house for publishing an article. https://hcservices.ecourts.gov.in/hcservices/

3.On that request only, Mr.N.Ram had given his opinion. But in this case, the Court has not asked the petitioner in Crl.M.P.(MD). No.5577 of 2019 to assist the Court for taking decision in this case. Therefore, the aforesaid decision will not help the petitioner in Crl.M.P.(MD).No.5577 of 2019.
