O R D E R

This Writ Petition has been filed challenging the impugned Refusal Check Slip No.RFL/Vaththalakundu/82/2025, dated 20.05.2025, issued by the respondent and consequently seeking a direction to the respondent to register the document presented by the petitioner without insisting upon production of the original parent document, within a time frame to be stipulated by this Court.

The learned counsel appearing for the petitioner would submit that the respondent refused to register the document solely on the ground that the petitioner was unable to produce the original parent title deed. He would further submit that the original parent document was misplaced and, therefore, the petitioner produced the certified copy of the same before the respondent.

3. The learned Special Government Pleader appearing for the respondent would submit that the document was refused only due to nonproduction of the original parent document. He would further submit that the respondent has been instructed to register the document upon production of the certified copy of the original title deed. 2/5

Considering the submissions made on either side, this Court finds that it has been consistently held that a certified copy of the parent document would suffice for the purpose of registration, in the event, the original is lost or misplaced. In the present case, it is not in dispute that the petitioner has produced the certified copy of the parent document, as the original was misplaced. Therefore, this Court finds no legal impediment for the respondent to register the document. The impugned Refusal Check Slip dated 20.05.2025 is therefore unsustainable and liable to be set aside.

5. Accordingly, the impugned Refusal Check Slip No.RFL/Vaththalakundu/82/2025, dated 20.05.2025 is set aside and the matter is remanded for reconsideration. The petitioner is directed to represent the sale deed dated 19.05.2025 along with the certified copy of the parent document before the respondent. Upon such re-presentation, the respondent is directed to register the document in accordance with law as expeditiously as possible, if it is otherwise in order. 3/5
