PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the third Respondent to issue separate patta for the property comprised in S.No. 200/2 now renumbered as S.No.201/1B1, situated at Orathanadu Taluk, Kallakkottai Estate, Aathangaraividuthi Village, Pudukottai District, admeasuring totally about 2 Acres 93 cents by considering the representations of the petitioner, dated 28.06.2018, 03.09.2018 and 29.12.2021 in accordance with law.

The writ petition has been filed in the nature of a Mandamus seeking consideration of an application seeking separate patta consequent to the purchase made by the petitioner in respect of the property in Survey No.200/2, renumbered as Survey No.201/1B1 at 2/5
Orathanadu Taluk, Kallakottai Estate, Athangarai Village, Pudukottai District, measuring 2.93 acres. The petitioner had also given a representation in this regard.

In the affidavit filed in support of the writ petition, the petitioner stated that she had purchased the aforementioned land by way of sale deeds registered as Document Nos.1839 of 1961, 276 of 1973, both registered in the Sub Registrar Office, Tiruvonam, and document No.754 of 1999 registered in the office of the Sub Registrar, Kandarvakottai. The total extent of the land is 2.96 acres. It had been reclassified as Survey No.201/1B1. The petitioner, seeks independent patta in her name. The patta also stands in the name of the vendors.

Let the petitioner file a fresh online application seeking patta and if it is filed, the third respondent may examine the sale deeds and if the petitioner is entitled, grant necessary independent patta in the name of the petitioner, after due enquiry. The Tahsildar may give necessary reasons, if a decision is otherwise taken. 3/5
4. At any rate, the third respondent should dispose of the online application from the date on which, it is filed, within a period of six weeks.
5. With the above directions, the writ petition stands disposed of. No costs.
