JUDGMENT

This writ appeal is directed against the order dated 12.12.2022 dismissing W.P.(MD)No.3198 of 2020 filed by the appellant association. 2.The case on hand pertains to filling up the vacancies in the post of Laboratory Technician Grade II in Health and Family Welfare Department. The grievance of the appellant association is that when their members are waiting the queue hoping to the appointed by way of direct recruitment, the government cannot frustrate their hopes by resorting to fill up the vacancies by way of transfer from the post of Laboratory Assistant (Malaria) in Tamil Nadu Public Health Subordinate Service. 3.The rules provide for filling up vacancy either by direct recruitment or recruitment by transfer from the post of Laboratory Assistant (Malaria). Thus, the government has a choice.

It can either resort to direct recruitment or it can resort to recruitment by transfer. The rules have been framed under Article 309 of the Constitution of India. The validity of the rules are not under challenge.
