O R D E R

This petition has been filed by the petitioners / Accused No.1 to 7 to call for the records pertaining to P.R.C.No.154 of 2024 on the file of the Judicial Magistrate No.II, Madurai for the offences under Sections 364A, 342, 294(b), 506(2), 147, 148, 34 of IPC and Section 4 of TN Prohibition of Harassment of Women Act, 2002, in Crime No.618 of 2023 and quash the same.

2. When the matter was taken up for hearing, the learned counsels on both sides represented that the matter has been amicably settled between the parties and to that effect, they have entered into a compromise and the same was filed before this Court.

3. The defacto-complainant and all the accused are present and this Court enquired about the terms of compromise. The defacto-complainant represented that they entered into a compromise and she has no objection Page No. 2 of 5

to quash the pending proceedings in P.R.C.No.154 of 2024. A compromise memo, dated 22.01.2025 signed by the parties and their respective counsel, is also filed before this Court.

4. The learned Government Advocate appearing for the first respondent submitted that as against the 1st petitioner, there are 11 previous cases, out of which, 7 cases have been acquitted and the remaining cases are pending.

5. This Court has perused the terms of the compromise memo dated 22.01.2025.

6. Considering dispute in respect of tenancy between the parties, the nature of the offences and they have also entered into a compromise, and though as against the 1st petitioner there are 11 previous cases, out of which, 7 cases have been acquitted and the remaining cases are pending and considering all other factors, this Court is inclined to allow this petition.
