For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.14 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120(b), 406, 420, 465 and 468 of IPC in Crime No.14 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that A1 to A3 along with one Sangeetha, who is the wife of this petitioner, are working as teachers in the Government Higher Secondary School, approached the de-facto complainant stating that they have influencial persons in the Government Department as well as in the ruling party and they can arrange the government job. Believing their words, the de-facto complainant attended Group-IV exam and subsequently, they demanded Rs.14,00,000/- to provide the same to the concerned Minister for arranging job and accordingly, the de-facto complainant paid Rs.14,00,000/- in the hands of A1 in front of this petitioner. Subsequently, on 13.11.2018, A1 to A3 informed that he was selected as Village Administrative Officer at Kanyakumari and also provided appointment order.

When the de-facto complainant went to Kanyakumari along with the appointment order to join duty, he was told that the appointment order is a forged one. It is a clear case of fake Government appointment order. On the basis of the complaint https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.1059 of 2022 given by the de-facto complainant, the case has been registered for the above said offences.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he is no way responsible for the entire transaction.

4.The learned Government Advocate (Crl. side) would submit that originally the FIR came to be registered against three persons and subsequently, during investigation, several complaints have been received and as of now, they came to know that a sum of Rs.1,16,00,000/- was collected from various persons by giving false promise to get Government job. He would further submit that they have already seized 33 government fake seals from the accused. 5.Considering the seriousness and gravity of the offence alleged and also the quantum of amount involved in the offence and that the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
