Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents. 2.The petitioner was found roaming in public on 30.04.2020 in violation of lockdown restrictions. Hence, the impugned FIR was registered. The respondent police should not have registered the FIR for the offence under Section 188 of IPC as that runs counter to the ratio laid down in the decision report in 2018(2) L.W (Crl.)606 (Jeevanandhan and others Vs. State rep. by Inspector of Police, Velayuthampalayam Police Station, Karur District and another). Crl.O.P(MD)No.1431 of 2022 angle, the impugned FIR is not maintainable. It is quashed and the criminal original petition is allowed. Consequently, connected miscellaneous petition is closed.
