Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the fourth respondent in Check Slip Number-1/2013, dated 10/05/2013, quash the same and direct the fourth respondent to register the sale deed dated 10/05/2013 presented by the petitioner for registration pertaining to the plot in Natham S.No. 44/3 measuring 3596 sq.ft. situated in Nannimangalam Village, Mummudicholamangalam Majra, Lalgudi Taluk, Trichy district.

ORDER

The present writ petition has been filed challenging an order passed by the fourth respondent herein, under which he has returned the sale deed presented by the writ petitioner for registration. 2/5

2. According to the learned counsel for the petitioner, the sixth respondent is the owner of the property and he enterned into a sale agreement with the petitioner on 11.04.2012. On the same date, the sixth respondent has executed a power deed in favour of the seventh respondent herein. Thereafter, based upon the sale agreement, the power agent had executed a sale deed in favour of the petitioner and it was presented for registration before the fourth respondent on 10.05.2013. On the same day, the sixth respondent had presented a document for cancellation of the power deed. The fourth respondent has accepted the power deed cancellation document and thereafter, returned the sale deed presented by the seventh respondent herein. Hence, the present writ petition has been filed to quash the said order and to direct the fourth respondent to accept the sale deed and registering the same.

The learned counsel for the petitioner further submits that the petitioner had filed O.S.No.176 of 2014 on the file of the II Additional Sub Court, Trichirappalli for the relief of specific performance as against the respondents 2 to 7. The said suit was decreed on 24.08.2015. Based upon the said decree, the sixth respondent himself has executed a sale deed in favour of the writ petitioner.

4. In view of the subsequent developments, no further orders are required to be passed in the writ petition. Hence, this Writ Petition is closed. No costs. Consequently, connected Miscellaneous Petition is closed.
