:Respondents PRAYER: Petition is filed under Section 482 of Cr.P.C., to direct the second respondent to register the complaint dated 23.11.2017 preferred by the petitioner and to take action against the accused persons in accordance with law.

O R D E R

This Criminal Original Petition has been filed to direct the second respondent, to register a case based upon the complaint given by the petitioner dated 23.11.2017.

2.The learned counsel appearing for the petitioner has submitted that the petitioner is working as a Territory Collection Manager in TVS Credit Service Limited at Palayamkottai, Tirunelveli District. He further submitted that the proposed accused has obtained a loan of Rs.3,85,308/- on 30.12.2013, for purchasing a Hyundai Verna Car bearing Registration No. TN 72 AF 5767. He further submitted that subsequently, the said proposed accused did not repay the loan and hence, the petitioner approached the said proposed accused and demanded to repay the https://hcservices.ecourts.gov.in/hcservices/

amount and at that time he used obscene words. He already dismantled the vehicle and sold its spare parts. Hence, the petitioner has lodged a complaint before the second respondent on 23.11.2017, but sofar, no action has been taken.

The learned Government Advocate (Crl.Side) appearing for the respondents has submitted that enquiry is still pending. 4.Considering the aforesaid submissions, the second respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, then he has to register a case and proceed further in accordance with law.

5.With the aforesaid observations, this Criminal Original Petition is disposed of.
