ORDER
Seeking to set aside the impugned order passed by the learned Principal District and Sessions Court, Srivilliputhur, Virudhunagar District in Crl.M.P.No.93 of 2026 in C.A.No.6 of 2026, dated 08.01.2026, this criminal original petition is filed.
2. Since no adverse order is passed against the 1st respondent, notice to the 1st respondent is dispensed with.
3. The learned counsel for the petitioner submitted that there is wide difference between the web copy of the impugned order and the certified copy of the impugned order. The learned Sessions Judge pointing out that the petitioner is unable / not willing to deposit atleast 10% or any minimum amount towards the compensation, had dismissed the petitioner's application for suspension of sentence. However, the learned counsel for the petitioner submitted that the petitioner is one 2/5
among the four accused. In this regard, the petitioner is very well prepared to pay 1/4th of the cheque amount and sought for the indulgence of this Court.

The impugned order is set aside, considering the allegation of involvement of a huge amount, on condition that the petitioner deposits an amount of Rs.10 Lakhs to the credit of C.C.No.3 of 2017 before the learned Judicial Magistrate No.I, Sivakasi, within a period of one week from the date of receipt of copy of this order. On payment of the same, the learned Principal District and Sessions Court, Srivilliputhur, Virudhunagar District is directed to suspend the sentence.
5. With these directions, this Criminal Original Petition stands allowed. Consequently, connected Miscellaneous Petition is closed. 27.01.2026 NCC : Yes / No Index : Yes / No Internet : Yes/ No gbg 3/5
