O R D E R

This Criminal Original Petition has been filed to direct the second respondent to register a case based upon the complaint given by the petitioner dated 23.01.2018.

2.The learned counsel for the petitioner has submitted that one KarthickPandian had purchased a Tata Indica Car bearing registration No.TN 60 M 8559 and used as a Taxi. He further submitted that on 12.02.2016, the said Karthickpandian entered into an agreement with the petitioner and as per the said agreement the said Car has been handed over to the petitioner and he has to run the said car as Taxi and also he has to pay the due to the finance company and accordingly the petitioner has paid a sum of Rs.2,50,000/- towards monthly installments to the finance company. But subsequently, on 14.11.2017 the said Karthick Pandian, made a request to give the said car for a day for visiting the temple. Considering his request the petitioner handed over the said car to the said Karthick Pandian. But thereafter, he did not return the car. He further submitted that the petitioner approached the said Karthick Pandian and requested him to return the vehicle. But, he refused to return the vehicle and also refused to return the https://hcservices.ecourts.gov.in/hcservices/

amount, which was paid by the petitioner and also criminally intimated him. Hence, the petitioner has lodged a complaint before the second respondent on 23.01.2018. But, so far no action has been taken.

3.The learned Government Adovcate (Crl.side) has submitted that with regard to the aforesaid allegations, already the petitioner has lodged a complaint on 15.12.2017, and after conducting enquiry the said complaint was closed on 17.12.2017. He further submitted that after disposing of the earlier complaint, the second respondent has not received any other complaint from the petitioner.

4.The second respondent is directed to inform the petitioner with regard to the disposal of his petition by RPAD. It is open to the petitioner to avail any other remedy available under the law. 5.Considering the aforesaid submissions, this petition is disposed of.
