ORDER

This Civil Revision Petition is filed to allow this civil revision 1/4

petition by setting aside the fair and decreetal order passed in I.A.No.4 of 2022 in O.S.No.531 of 2021 dated 24-11-2022 on the file of the II nd Additional District Munsif Court, Tirunelveli.

2. Learned counsel for the petitioner submitted that the petitioner herein has filed a suit in O.S.No.531 of 2021 against the respondents herein. In that suit, he has taken out an application in I.A.No.4 of 2022 under Order 26 Rule 9 and Section 151 of CPC, seeking appointment of advocate commissioner to identify whether there is an electricity connection stands in the name of the petitioner. The trial court has dismissed the same, taking into consideration that service connection has to be examined by proper evidence and such evidence cannot be taken into consideration by an appointment of Advocate Commissioner.

3. The reasons given by the trial court needs more interference as the same was considered on merits and an advocate commissioner cannot be permitted for collection of evidence.

4. For the aforesaid reasons, I do not find any merits in this Civil Revision Petition. Accordingly, this Civil Revision Petition is dismissed. No costs.
