O R D E R

This Criminal Original Petition has been filed by the petitioner, to direct the second respondent not to harass the petitioner under the guise of enquiry.

2.The learned counsel appearing for the petitioner has submitted that already the petitioner has filed a divorce petition in I.D.O.P.No.92 of 2017, on the file of the Principal District Judge, Thanjavur, and that being so, the petitioners's wife gave a false complaint before the second respondent, stating that the petitioner has caused cruelty by demanding dowry and based on the said complaint, the second respondent is harassing the petitioner. 3.The learned Government Advocate (Crl. Side) has submitted that the petitioner's wife gave a false complaint against the petitioner, stating that the petitioner has caused cruelty by demanding dowry and C.S.R.No.12 of 2018 has been issued and the enquiry is still pending.

4.Considering the aforesaid submissions, the second respondent is directed to enquire the complaint with regard to the complaint given by her and if the enquiry reveals any cognizable offence, then he has to register a case and proceed further in accordance with law, instead of doing so, the petitioner should not be harassed unnecessarily.

5.With the aforesaid submissions, this Criminal Original Petition is disposed of.
