By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 2.The prayer in the present writ petition cannot be entertained for the reason that the petitioner cannot have a priority over any future vacancy that may arise for the purpose of appointment. The only ground raised by the petitioner in the present writ petition is that he comes under the category of inter-caste priority and therefore, he requires to be considered.
3.The procedure for selection is stipulated under the regulation of every Government Department and whenever a vacancy arises in the basic service and the concerned employment exchange sponsors the candidates for the said vacancy, the selection would be done in accordance with the regulations. It is needless to point out that if the petitioner is otherwise entitled to the selection https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD) No.1438 of 2021 process, it is always open to him to go under the due process of law. In this background, it would not be appropriate for this Court either to direct the respondent to consider his request for appointment to any future vacancy or to issue mandamus for the same purpose.
