RESPONDENT/ RESPONDENT Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Stay the Operation of the Order passed in I.A.No.109 of 2018 in H.M.O.P.No. 27 of 2018 on the file of the Learned Subordinate Judge, Aruppukottai, Virudhunagar District dated 18.10.2019 pending disposal of the main Civil Revision Petition. Prayer in CRP(MD). 138/ 2020 :

To prefer this Memorandum of Grounds of Civil Revision Petition against the Fair and Decreetal order dated 18.10.2019 passed in I.A.No.109 of 2018 in H.M.O.P.No. 27 of 2018 on the file of the Learned Sub Court, Aruppukottai, Virudhunagar District awarding a sum of Rs.6000/- per month as Interim Maintenance and Litigation Expenses Rs.1,000/- to the Respondent herein and the two female children each (Rs.3000/-in total) from the date of this Interim Maintenance Petition by raising the following among other. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.C.SURESH KANNAN, Advocate for the petitioner and of Mr.S.J.

CHAKKKARAVARTHY, Advocate on behalf of the Respondent, the court made the following order:- This petition has been filed to stay the operation of the order passed in I.A.No.109 of 2018 in H.M.O.P.No..27 of 2018 on the file of the learned Sub Court, Aruppukottai, Virudhunagar District, dated 18.10.2019 pending disposal of the main Civil Revision Petition. 2.On the side of the petitioner, it is stated that the petitioner has deposited a sum of Rs.50,000/- before the Trial Court as per the direction of this Court dated 28.01.2020. The copy of the receipt along with the memo is recorded.

CMP(MD) No.772 of 2020 3.On the side of the respondent, it is stated that in Domestic Violence Case, the Court below has ordered the petitioner to deposit a sum of Rs.6,000/- per month. That amount was not deposited by the petitioner and the petitioner is to deposit an arrear amount of Rs.1,50,000/- and prayed to direct the petitioner to deposit the arrear amount and the respondent seeks permission of this Court to withdraw the amount already deposited by the petitioner. 4.On the side of the petitioner, it is stated that the order copy of the Domestic Violence Case is not ready. On receipt of the order copy, the petitioner is ready to deposit the amount periodically.

5.Heard both sides.

6.Considering the facts and circumstances, this Court directed the petitioner to pay the balance amount of the arrears within a period of two months from the date of receipt of copy of this order and further directed to deposit a sum of Rs.3,000/- per month before the Trial Court till the disposal of the Civil Revision Petition. 7.With the above direction, this Civil Miscellaneous Petition is allowed.
