RESPONDENT/ RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to modify the condition imposed in the order dated by this Honourable Court in Crl.O.P(MD).No.6169/2019 dated 27/04/2019. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of MR.J.DAVID GANESAN, Advocate for the petitioner and of Mrs.M.ANANTHA DEVI, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- The petition has been filed to modify the condition imposed on the petitioner in CRL OP(MD) No.6169 of 2019.
2. The learned counsel for the petitioner would submit that the petitioner herein was granted anticipatory bail on condition that the petitioner shall deposit a sum of Rs.20,000/- to the credit in crime number 74 of 2019 before the learned Judicial Magistrate, Sathankulam, Thoothukudi District without prejudice to his defence and only on such deposit the learned Magistrate shall accept the sureties and disburse the same to the defacto complainant without filing any formal application. He would further submit that due to heavy financial crisis in his life, he could not deposit the said amount. Hence he seeks to modify the said condition.
3. It is seen from the order passed by this Court in Crl.O.P (MD) No.6169 of 2019 on 27.04.2019, that this Court has observed that the on instructions the learned counsel for the petitioner https://hcservices.ecourts.gov.in/hcservices/
has submitted that the petitioner is ready and willing to deposit a sum of Rs.20,000/- to the credit in crime number 74 of 2019 before the learned Judicial Magistrate, Sathankulam, Thoothukudi District without prejudice to his defence and only on such deposit the learned Magistrate shall accept the sureties and disburse the same to the defacto complainant and on considering his request, this Court has granted anticipatory bail.
