PRAYER IN CRL MP(MD)No.3791 of 2020 IN CRL A(MD)No.240 of 2020: Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to suspend the sentence of Imprisonment imposed by the learned Principal Sessions Judge, Sivagangai in S.C.No.105 of 2012 by the Judgment dated 27.2.2020 and enlarge the Petitioners/Appellants on bail, pending disposal of the above said Criminal Appeal. PRAYER IN CRL A(MD)No.240 of 2020:
To set aside the Judgment and conviction dated 27.02.2020 by the Learned Principal Sessions Judge, Sivagangai in S.C.No.105 of 2012 and acquit the Appellant.
Order :This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.D.RAMESH KUMAR, Advocate for the petitioner and of Mr.R.ANANDARAJ, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This petition has been filed seeking relaxation of the condition imposed by this Court in Crl.M.P(MD)No.3791 of 2020 in Crl.A(MD)No.240 of 2020, dated 17.08.2020. CRL MP(MD) No.1925 of 2021 granting suspension of sentence to the petitioner directed him to stay at Madurai and appear before the learned Judicial Magistrate, Manamadurai at 10.30 a.m., on the first working day of every month until further orders.
2. The learned counsel appearing for the petitioner would state that the petitioner has been complying with the said condition from 01.09.2020. He would further state that the petitioner is a daily wage worker and he is the sole bread winner of his family, hence, it is very difficult for him to stay at Madurai.
3. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and perused the materials available on record.
4. In the light of the above statement of the learned counsel for the petitioner, the condition imposed on the petitioner in Crl.M.P(MD)No.3791 of 2020 in Crl.A(MD)No.240 of 2020, dated 17.08.2020 is modified directing the petitioner to appear before the committal court on the first working day of every month at 10.30., until further orders.
5. Accordingly, this petition is ordered.
