ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.
2. The petitioner apprehending arrest at the hands of the respondent police for the offences under sections 147, 148, 342, 323 and 302 r/w. Section 109 of I.P.C., in Crime No.24 of 2020 on the file of the respondent police, seeks anticipatory bail.
3. The petitioner's counsel would point out that the petitioner was not even present in the scene of occurrence and that there are materials to indicate that the petitioner was working in the school https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.1133 of 2020 during the relevant time. The petitioner's counsel would pass on the extract of the attendance register.
4. The learned Government Advocate (Crl. Side) points out that the case against the petitioner is that he had instigated the commission of the crime. The petitioner's role has been brought out in the confession given by A1/Paulraj.
5. It is not the case as if there are no materials against the petitioner. It is too early to pronounce on the guilt or otherwise of the petitioner. It is a matter for investigation. Since it is a case of murder and grant of anticipatory bail will tie the hands of the investigation, I am not inclined to grant anticipatory bail to the petitioner.
