PRAYER :- for bail in Crime No.53 of 2019 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner is in custody since 03.10.2019 for the offences punishable under sections 8(c) r/w 20(b)(ii)(c) and 25 of NDPS Act, in Crime No.53 of 2019 on the file of the respondent police. He seeks bail.

3. This is a case of recovery of 300 kg of ganja from the petitioner. The petitioner was arrested on 03.10.2019 during routine vehicle check up.

4.The case of the prosecution is that the petitioner was driving a car (white color zylo) in question and on seeing the police party, the car did not stop at the interception point but stopped at a little far away. One person got out the car and escaped. The petitioner alone was secured.

No.1136 of 2020 5.The prosecution states that the petitioner has not given any useful clue to identify the person who escaped from the car. 6.The learned Government Advocate (Crl.side) would state that the petitioner has not extended his co-operation for the investigation. Since the petitioner has not properly co-operated with the investigation and since huge commercial quantity of ganja was recovered only from the petitioner, I am not inclined to grant relief. The petitioner is at liberty to renew the bail petition after filing of the final report. Hence, this criminal original petition stands dismissed.
