O R D E R

This Criminal Original Petition has been filed by the petitioner, to direct the second respondent to provide police protection to the petitioner for running petty shop No.2 situated in front of Arappalayam bus stand, Madurai.

2.The learned counsel appearing for the petitioner has submitted that the petitioner took the said shop on lease from the Tamil Nadu Housing Board, Madurai. He further submitted that the third respondent, who was working in the petitioner's shop, made a request to hand over the shop to him and accordingly, the petitioner has handed over the shop to the third respondent, but he failed to pay rent to the Housing Board. The Housing Board has issued notice to the petitioner, stating that a sum of Rs.1,72,619/- is due towards arrears on rent and hence, the petitioner has directed the third respondent to hand over the possession of the shop but he refused to hand over the possession. petitioner has lodged a complaint before the second respondent, but the second respondent has not taken any action on the said complaint.

3.The learned Government Advocate (Crl. Side) has submitted that after receipt of the complaint, enquiry has been conducted and it was found that the petitioner has subleased the said shop to the third respondent and considering the said fact, the said complaint has been closed, directing the parties to approach the Civil Court and get appropriate remedy.

4.Recording the aforesaid submissions, this Criminal Original Petition is disposed of. It is open to the petitioner to avail any other remedy, which is available under the law.
