2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The grievance of the petitioner is that the subject property originally belonged to the petitioner's maternal grandmother, who inherited the same by way of succession. After her demise, the petitioner's mother and other legal heirs proposed to effect mutation in the revenue records in their names.
4. Meanwhile, the petitioner's maternal uncle, namely Alagu Sundaram, unlawfully obtained transfer of patta in his name by suppressing the rights of the other female heirs of the petitioner's Page No. 2 of 6
grandparents, without any valid documents and without issuing notice to the other legal heirs.
5. Therefore, the petitioner made a representation dated 14.10.2024 to the first respondent and the same was forwarded to the third respondent and taken on file as File No.O.Mu.No.7283/2025/A2. The third respondent sent a letter dated 03.06.2025 to the Revenue Inspector, Kodagipatti, calling for the relevant revenue records pertaining to the subject land. Thereafter, no further action has been taken on the petitioner's representation. Therefore, the petitioner has filed the present Writ Petition.
6. The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that the petitioner's application/representation in File No.O.Mu.No.7283/2025/A2 would be disposed of by the second respondent within a period of sixteen weeks.
7. Mr.G.Thalaimutharasu, the learned counsel appearing for one Chelladurai, the son of the said Alagu Sundaram, who is not a party to this Writ Petition, submits that the said Chelladurai is a necessary party and Page No. 3 of 6
therefore, he may be heard before passing any orders on the petitioner's application/representation.
8. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's application/representation in File No.O.Mu.No.7283/2025/A2 on its merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The application/representation shall be disposed of after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, the said Chelladurai and any other interested parties who may be affected by such decision before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
