O R D E R
The Petitioner herein seeks a direction to the first respondent to dispose of the Petitioner's appeal, dated 18.12.2020 with regard to insertion of the Petitioner's name in the Joint patta of the Petitioner's father's land at Narippaiyur, Kadaladi Taluk, Ramanathapuram District in Patta Nos.
68,104, 127,128,210,239,413, 609, 770,1066, 1960, 1961, 1963, 1964, 1966, 1967, 1981,2032, 10427, 10912 and the lands in patta Nos. 5531 and 290 at Tharaikudi Village, Kadaladi Taluk, Ramanathapuram District.
2.Heard the learned counsel appearing on either side and 2/6
perused the materials placed before this Court. 3.According to the Petitioner, the above-mentioned properties originally belong to the Petitioner's father Muthuhamy Thevar. He died on 9.4.2006 leaving behind 11 legal heirs namely, 8 sons and three daughters. The Petitioner is one of the daughter of Muthuchamy Thevar. It is asserted by the Petitioner that based on an invalid legal heirship certificate produced before the authorities, the revenue documents got mutated in the name of Petitioner's 8 brothers alone leaving the name of the Petitioner and other sisters. Therefore, the Petitioner submitted an application before the second respondent seeking inclusion of her name in the patta for the above mentioned properties. However the second respondent has not passed any order in the representation of the Petitioner. Therefore, the Petitioner submitted an appeal before the second respondent on 18.12.2020 and the same is still pending on his file. Therefore the petitioner has come to this Court with the present Writ petition for the relief stated supra.
4.The learned Government Advocate, who appear for the respondents 1 and 2 would submit that the appeal submitted by the Petitioner will be considered on its own merits within the 3/6
time stipulated by this Court.
5.Mr.A.K.Manikkam, learned counsel appearing for the respondents 3 and 4 would submit that the respondents 3 and 4 are brothers of the Petitioner and the first respondent shall be directed to hear them also before passing any order on the representation submitted by the petitioner.
6.In the light of the above submission made by the learned counsel for the respondents 3 and 4, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the appeal filed by the Petitioner, dated 18.12.2020 and pass final orders on its own merits after issuing notice to the Petitioner, respondents 3 and 4 and other legal heirs of Muhuchamy Thevar, within a period of 8 weeks from the date of a copy of this order.
7.With the above directions, the Writ Petition stands disposed of. No costs.
