O R D E R

This Criminal Original petition has been filed to direct the second respondent police to register a case on the basis of the complaints dated 31.07.2017 and 24.08.2017.

The learned counsel for the petitioner has submitted that the petitioner has put up a small hut in a Government Puramboke land, for that, the Government has issued a memo and that being so, the proposed accused interfered with the petitioner's agricultural work on 31.07.2017 and forcefully entered into the petitioner's land and driven away the agricultural coolies, claiming that they got patta in their favour. With regard to that, the petitioner has lodged a complaint before the second respondent on 08.08.2017. He further submitted that subsequently, on 24.08.2017, the same proposed accused persons had broke opened the lock of the petitioner's hut and criminally intimidated the petitioner to vacate from the said hut. With regard to the said occurrence also, the petitioner has lodged a complaint on 19.09.2017. He further submitted that on both the complaints, the second respondent has not taken any action and hence he filed this Criminal Original Petition.

The learned Government Advocate (Crl.side) has submitted that after receipt of the first complaint, CSR.No.575 of 2017 has been issued and after enquiry, the said complaint was closed as civil dispute. Subsequently, the petitioner has lodged another complaint and for that, CSR.No.700 of 2017 has been issued and after enquiry, the said complaint was also closed as civil dispute. He further submitted that the petitioner has been directed to approach the Revenue Divisional Officer to get appropriate remedy.

4. The learned counsel appearing for the petitioner, by way of reply, has submitted that the second respondent has not informed the petitioner with regard to the closure of his complaints. 5.

Considering the aforesaid submissions, the second respondent is directed to inform the petitioner with regard to the closure of his complaints within the period of one week from the date of receipt of a copy of this order. It is open to the petitioner to avail any other remedy, which is available under law.

6. With the aforesaid observations, this Criminal Original Petition is disposed of.
