ORDER : The Court Made the following order :- The petitioners are arrayed as Accused Nos.1 to 3 in Crime No.154 of 2015 on the file of the respondent police, for the offences punishable under Sections 147 and 148 of the Indian Penal Code and also under Section 3 of TNPPDL Act. The petitioners were arrested and remanded to judicial custody on 16.07.2015. They have come forward with this petition seeking bail.
2. The case of the prosecution is that on 15.07.2015, the petitioners caused damage to the vehicle of the defacto complainant worth about Rs.25,000/-.
3. The learned counsel for the petitioners submitted that they are innocent and they have been falsely implicated in this case. He has further submitted that totally there are 12 accused and the petitioners are ready to deposit Rs.2,000/- each to the credit of Crime No.154 of 2015 without prejudice to their right in the criminal case.
4. The learned Government Advocate (Criminal Side) submitted that the petitioners have caused damage to the window and door of a Car belonged to the defacto complainant to the tune of Rs.25,000/-. https://hcservices.ecourts.gov.in/hcservices/
5. Considering the facts and circumstances, this court is inclined to grant bail to the petitioners on condition that the
petitioners shall deposit a sum of Rs.2,000/- (Rupees Two Thousand only) each to the credit of Crime No.154 of 2015 before the learned Judicial Magistrate, Srivaikundam within a period of two weeks and on receipt of the same the petitioners are directed to be released on bail, on each of them executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Srivaikundam and on further condition that the petitioners shall stay at Melur and report before the Melur Police Station daily at 10.00 a.m. until further orders.
