For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 347 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 IPC, in Crime No.347 of 2021, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused had stolen goats worth about Rs.15,000/- from the godown of defacto complainant. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent and not committed any such offence as alleged by the prosecution. He would further submit that the petitioner is an auto driver and he was hired by the other accused persons.
4.The learned Government Advocate (Crl.Side) appearing for the respondent would submit that in this case totally eight persons involved and the stolen property were seized from the co-accused and still now two accused persons are absconding. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.1139 of 2022 5.The contention of the learned counsel for the petitioner that the petitioner is an auto-driver and he was hired by the other accused persons, cannot be accepted at this stage.
