ORDER : The Court made the following order :- The petitioner/sole Accused herein, who was arrested on 04.01.2022 for the alleged offence under Sections 379 of IPC r/w. Section 21(4) of mines and minerals (development and Regulation Act), 1957, on the file of the respondent police, seeks bail. 2.The allegation against the petitioner is that he transported 1⁄2 unit of river sand in a bullock cart, without any valid licence. 3.On the side of the petitioner, it is stated that the petitioner was arrested on 04.01.2022 and the allegation is that he transported only 1⁄2 unit of river sand and prayed the petitioner to be released on bail.

4.On the side of the prosecution, it is stated that the petitioner is having two previous cases similar in nature and prayed the petition to be dismissed.

CRL OP(MD). No.1068 of 2022 5.Considering the previous antecedents of the petitioner, this Court is not inclined to release the petitioner on bail at the present stage.
