Prayer: This Criminal Original Petition filed under Section 482 Cr.P.C, to modify the condition imposed in Crl.M.P.No.3530 of 2019 dated 09.12.2019 passed by the learned Principal Sessions Judge, Pudukkottai and permit the petitioner / accused either to appear before the learned Judicial Magistrate, Keeranur or before the respondent police.

ORDER

The Criminal Original Petition has been filed to modify the condition imposed in Crl.M.P.No.3530 of 2019 dated 09.12.2019 passed by the learned Principal Sessions Judge, Pudukkottai and permit the petitioner/ accused either to appear before the learned Judicial Magistrate, Keeranur.

2. The learned counsel for the petitioner would submit that the petitioner was granted bail in Crl.M.P.No.3530 of 2019, dated 09.12.2019, with a condition to stay at Karaikudi and report before the learned Judicial Magistrate, Karaikudi, daily at 10.30 a.m and the learned Magistrate also directed that the petitioner should not enter into the occurrence village. He would further submit that due to his poverty the petitioner is unable to stay at Karaikudi and report before the learned Judicial Magistrate, Karaikudi and thereby he had filed a petition seeking for modification in Cr.M.P.No.42 of 2020 and the trial Judge had dismissed the modification petition and hence, the petitioner filed this petition.

3. Having regard to the submission made by the learned counsel for the petitioner and the other facts and circumstances of the case, this Court is inclined to modify the condition imposed in Cr.M.P.No.3530 of 2019, dated 09.12.2019 and hence, the petitioner https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.1439 of 2020 shall report before the respondent police daily at 10.00 a.m until further orders.

4. In the result, the Criminal Original Petition is ordered as indicated above.
