ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the third respondent to provide the survey number and other revenue records relating to the property comprised in Old Door No.23, New Door No.4, Old Ward No.4, New Ward No.7, Batcha Rowther Street, Vedasandur Town, Dindigul District and adjacent empty land near the above mentioned property, by considering the petitioner's representation dated 22.11.2025.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel for the petitioner submits that the petitioner entered into a valid and registered sale agreement in January 2019 with the lawful owners of the property for valuable consideration and paid a substantial advance of Rs.5,50,000, always remaining ready and willing to perform his part of the contract. Owing to the deliberate refusal of the vendors to receive the balance

consideration and execute the sale deed, the petitioner was constrained to file a suit for specific performance, which culminated in an ex parte decree in his favour in November 2021. Despite the decree, the judgment-debtors failed to comply, necessitating execution proceedings, pursuant to which the competent civil court approved and finalized a draft sale deed in accordance with law. However, the Sub-Registrar, Vedasandur, refused to register the court-approved sale deed on the ground of non-mention of the survey number, which is arbitrary, mechanical, and contrary to settled legal principles, particularly, when the property is otherwise clearly identifiable.

Therefore, the petitioner made repeated representations to the concerned revenue authorities seeking clarification of the survey number, including a formal representation in November 2025, but no response was forthcoming, leaving the petitioner remediless. The inaction of the authorities has rendered a valid judicial decree ineffective, thereby, infringing the petitioner's constitutional and legal rights. Having exhausted all alternative and administrative remedies, the petitioner has rightly invoked the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India.

5. The learned Additional Government Pleader appearing for the respondents submits that the petitioner's representation will be considered and appropriate orders will be passed in accordance with law, within a time frame to be fixed by this Court.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 22.11.2025 and pass appropriate orders on merits and in accordance with law, within a period of sixteen weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
