PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the 2nd respondent to execute the warrant issued on 10.02.2023 by the learned Judicial Magistrate No.I (Fast Track Magistrate Level), Srivilliputtur in STC.No.748 of 2022.

ORDER

The present petition is filed for directing the second respondent to execute the non-bailable warrant issued on 10.02.2023 by the learned Judicial Magistrate No.I (Fast Track Magistrate Level), Srivilliputtur in STC.No.748 of 2022 against the accused.

2.The contention of the learned counsel for the petitioner is that though the petitioner/complainant filed a private complaint under Section 200 Cr.P.C. against the accused for an offence punishable under Section 138 of Negotiable Instruments Act, 1881, the accused did not appear before the concerned Court, on account of which, a non bailable warrant was issued by the learned Judicial Magistrate No.I, (Fast Track Magistrate Level), Srivilliputtur, on 10.02.2023. According to him, till date, the police had not executed the non bailable warrant.

3.In such circumstances, the second respondent/the Inspector of Police, Y.Othakadai Police Station, Madurai District, is directed to execute the non bailable warrant issued by the learned Judicial Magistrate No.I, (Fast Track Magistrate Level), Srivilliputtur, arrest the accused and produce him before the 2/4

concerned Court within a period of two months from the date of receipt of a copy of this order/uploading the order in the official web-site of this Court. 4.With the above directions, this Criminal Original Petition stands disposed of.
