... Respondent/Complainant For Petitioner : M/s. Lenin Kumar.T, Advocate. For Respondent : M/s.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 7 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Clause 6 (4) of TNSC (RDCS) Order 1982 r/w. 7 (1)(a)(ii) of Essential Commodities Act, 1955, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other accused were illegally transported PDS rice.

3. On the side of the petitioner, it is stated that the petitioner employed A1 and A1 was found in possession of PDS rice and the allegation is that A1 had purchased PDS rice from card https://hcservices.ecourts.gov.in/hcservices/

holders and the value of the rice is only Rs.11,000/- and prayed the petitioner to be released on anticipatory bail.

4. On the side of the respondent, it is stated that the petitioner and other accused were transporting PDS rice illegally. The petitioner is having two previous cases, which are similar in nature and he strongly opposed for the grant of anticipatory bail to the petitioner.

5. It is seen that the Rice involved is 40 bags (40 bags X 50Kg = 2000 Kgs) and the petitioner is having two previous cases. Considering the previous antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner at this juncture. Hence, this petition is dismissed.
