ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 406, 420 and 120B IPC in Crime No.23 of 2022 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other accused said to have canvassed the people about the job in abroad. On the basis of the promise, several persons have paid amount. As per the FIR 120 persons have paid the amount totally about Rs.60,00,000/-. After collecting the amount, the above said office was found locked. Hence, the complaint.

3.Considering the submissions made by the learned Additional Public Prosecutor that about 1 Crore rupees is involved in this matter and that some of the accused persons were arrested and remanded in judicial custody, the custodial interrogation of the petitioner is necessary, this Court dismissed the earlier application seeking anticipatory bail, filed by the petitioner. 4.This is second anticipatory application. Today, the learned Additional Public Prosecutor submitted that this petitioner has made the advertisement and issued pamphlets and also introduced the accused Nos.1 and 2 to the public and collected money from the public.

5.However, considering the facts and circumstances of this case, this Court is inclined to grant anticipatory bail to the petitioner on conditions.

6.Accordingly, this Criminal Original Petition is allowed and petitioner is ordered to be released on bail in the event of arrest or on her appearance, before the learned Judicial Magistrate No.II, Sivagangai, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall co-operate with the respondent police, to complete the investigation process. If any necessity arises, the respondent police is at liberty to approach the concerned Court for making custodial interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
