O R D E R

This petition has been filed to direct the second respondent to register a case based on the petitioner's complaint dated 20.01.2018.

2. Heard the learned counsel appearing for the petitioner and the Government Advocate (Crl.Side) appearing on behalf of the respondents.

3. The learned counsel for the petitioner has submitted that the petitioner has purchased a lorry bearing registration no. TN04 E 3009 on 11.09.2017 from one Babu. He further submitted that the petitioner has entrusted the lorry to his driver and the driver has used the said lorry for transporting sand and hence the Aranthangi police has seized the said lorry and produced before the RDO, Aranthangi. When the petitioner came to know about the fact, he tried to get back the lorry from the RDO. At that time, one Kamalakannan approached the petitioner and stated that if the petitioner paid Rs.40,000/-, he will make arrangements for getting back the vehicle from the RDO. He further submitted that believing his words, the petitioner has paid Rs.40,000/- to him. Subsequently, the petitioner came to know that the said https://hcservices.ecourts.gov.in/hcservices/

Kamalakannan has got name transfer of the vehicle in his name and he is refusing to return back the vehicle and also the amount, against which the petitioner has lodged a complaint before the second respondent on 20.01.2018, but so far no action has been taken.

4. The learned Government Advocate (Crl.Side) has submitted that after receipt of the said complaint, CSR No.20 of 2018 was issued and after enquiry, the said complaint was closed on 20.01.2018 as the dispute is relating to money transaction.

5. Recording the aforesaid submissions, this criminal original petition is disposed of. It is open to the petitioner to avail any other remedy which is available under law. Sd/- Assistant Registrar(CS-II) /True Copy/ Sub Assistant Registrar To
