ORDER : The Court Made the following order :- The petitioner, who is arrayed as A3, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 4, 5 and 6 of the Explosive Substance Act, in Crime No.289 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2.According to the prosecution, on 25.07.2015 the Inspector of Police has received secret information that explosive substances were kept in the premises of the petitioner and the officials were in surveillance and intercepted a car bearing Registration No.TN66 K6565 in which A1 and A2 were travelling and recovered a bomb and knife and on the confession of A1, one bomb was recovered from the house of A3. 3.The learned counsel for the petitioner submitted that the petitioner is an employee of the Southern Railway and the first accused is the brother-in-law of the petitioner. It is further submitted that the petitioner was implicated only based on the confession of A1 and he has no connection with A1 and A2.

4.The learned Government Advocate (Crl.side) submitted that the petitioner has leased out his house to A1 and A2 where they have kept a bomb and lethal weapon and A1 and A2 are involved in so many criminal cases and the petitioner has no bad antecedent. She further submitted that A1 and A2 were arrested and remanded to judicial custody. 5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Trichy and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 06.00 p.m until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 04/08/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
