PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the learned Judicial Magistrate, Tenkasi to expeditiously dispose the case in C.C.No.37 of 2018 in Crime No. 22 of 2017 on the file of the respondent.

ORDER

This petition has been filed seeking direction to direct the learned Judicial Magistrate, Tenkasi to expeditiously dispose the case in C.C.No.37 of 2018 in Crime No. 22 of 2017 on the file of the respondent.

2. The learned counsel for the petitioner would submit that on the false complaint given by the wife of the petitioner a case in Crime No. 22 of 2017 was registered by the respondent police against the petitioner and one Varlarmathi for the offences under Sections 294(b), 498(A), 494 and 506(i) of IPC. He would also submit that final report has been filed before the concerned court as early as on 22.12.2017. Despite the lapse of three years, the trial court has not commenced the trial. He would also submit that right of speedy trial is the constitutional guarantee given to the accused. Hence he has filed the present petition.

2. The learned Additional Public Prosecutor would submit that there are totally eleven witnesses in this case and the case is posted for examination of LW. 1 to 3 on 10.02.2020. https://hcservices.ecourts.gov.in/hcservices/

3. Under such circumstances , there shall be a direction to the learned Judicial Magistrate, Tenkasi to dispose the case pending in C.C.No.37 of 2018 within a period of four months from 10.02.2020 and report compliance to this court after completion of the proceedings.

4. With the above direction, the Criminal Original Petition is disposed of.
