PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents 1 and 2 to grant prior permission to the petitioner's College to fill up the sanctioned Teaching and Non-Teaching Staff post by considering the proposals dated 09.09.2022, 23.09.2022 and 25.10.2022 submitted by the petitioner's College within a time frame that may be fixed by this Court. This Writ Petition has been filed for a direction to the respondents 1 and 2 to grant prior permission to the petitioner's College to fill up the sanctioned Teaching and Non-Teaching Staff post, by considering the proposals dated 09.09.2022, 23.09.2022 and 25.10.2022 submitted by the petitioner's College within a time frame that may be fixed by this Court.

2. The case of the petitioner is that the petitioner College is an Aided College and the Aided College must get prior permission from the concerned Authority to fill the vacancies that arises in the sanctioned positions. Hence, the petitioner College have sent proposals dated 09.09.2022, 23.09.2022 and 25.10.2022. But, till date, the same have not been considered. Therefore, the petitioner has filed the present Writ Petition with the aforesaid prayer.

3. The learned counsel appearing for the petitioner would submit that it would suffice, if the first respondent is directed to consider the proposal of the petitioner, dated 25.10.2022, on merits and in accordance with law, within a specified period.

4. The learned Government Advocate appearing for the respondents has no serious objection for such an order being passed by this Court.

5. Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the matter, directs the first respondent to consider the petitioner's proposal, dated 25.10.2022 and pass appropriate orders, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
