O R D E R

This petition has been filed by the accused to direct the learned Judicial Magistrate -III Tuticorin to dispose of the case in C.C.No. 492 of 2017 at an early date.

2.The learned counsel for the petitioner has submitted that the respondent herein has registered the case in Crime No.290 of 2012 for the offences punishable under Sections 341, 324, 506(ii) IPC against the petitioner herein and subsequently, he has filed a charge sheet in the year 2014 and based on the same, the learned Judicial Magistrate -III Tuticorin, has taken the case on file in C.C.No. 184 of 2014 and subsequently, the said case has been transferred to Judicial Magistrate -III, Tuticorin and it was taken on file as C.C.No. 492 of 2017.

3. He further submitted that though the case was registered in the year 2012 and the charge sheet was laid in the year 2014, so far, no progress has been made in the aforesaid case and hence he https://hcservices.ecourts.gov.in/hcservices/

requests this Court to give a suitable direction to the concerned trial Court for early disposal of the aforesaid case. 4.The learned Government Advocate (Crl.Side) has submitted that totally 10 witnesses have been cited on the side of the prosecution and now the case is posted to 08.03.2018 for appearance of the witnesses Nos.1 to 3. He further submitted that the respondent will serve the summons to the witnesses Nos.1 to 3 for their appearance on 08.03.2018 and thereafter, they will take steps to produce all other witnesses without taking unnecessary adjournments.

5.Considering the aforesaid submissions, the learned Judicial Magistrate -III, Tuticorin is directed to dispose of the case in C.C.No. 492 of 2017 within a period of four months from the date of receipt of a copy of this order. The respondent is directed to produce the witnesses without taking any unnecessary adjournments. After the witnesses are produced the petitioner shall examine them without seeking adjournments.

6.With the aforesaid directions, this criminal original petition is disposed of.
