(R-2 is suo motu impleaded and R-2 to R-6 rank rearranged as R-3 to R-7 vide Court order dated 25.01.2022 in W.P.(MD).No.1078 of 2022) Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of impugned proceeding dated 07.01.2022 for "RE DO" list passed by the fifth respondent with respect to petitioner only (A.Prem Jothi) and quash the same as illegal and to direct the first and fifth respondents to allow petitioner (A.Prem Jothi) for writing the fifth semester examination and participating 6th semester online class conducted by the fifth respondent.

For Petitioner : Mr.M.A.M.Raja For R-1 and R-2 : Mr.K.P.Krishna Doss For R-3 to R-5 : Mr.D.Sasikumar, Additional Government Pleader.

ORDER

Mr.D.Sasikumar, learned Additional Government Pleader, on instructions, submits that the petitioner has been permitted to appear for the examination scheduled to take place in February 2022 on payment of condonation fee of Rs.1000/-.

2. Learned counsel for the petitioner, on instructions, submits that the petitioner has already paid the condonation fee and therefore, he may be permitted to write the examination scheduled to take place in February 2022.

3. After recording the statements made by the respective counsels, the Writ Petition is disposed of by directing the fifth respondent to permit the petitioner to write the odd semester examination scheduled to take place in February 2022 subject to payment of Rs.1000/- towards the condonation fee. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
