O R D E R

This Criminal Original Petition has been filed to direct the second respondent, to register a case based on the complaint given by the petitioner dated 27.12.2017.

2.Heard Mr.B.Jameel Arasu, the learned counsel appearing for the petitioner and Mr.Prabu Ramachandran, the learned Government Advocate (Crl.Side) appearing for the respondents. 3.The learned counsel appearing for the petitioner has submitted that the petitioner and the proposed accused were friends. The said proposed accused approached the petitioner and made requests to lend loan for a sum of Rs.1 lakh and for that the petitioner not agreed. He further submitted that after few days, again the said proposed accused came to the petitioner's office and at that time the petitioner has signed in a cheque and kept on the table for the purpose of giving to one of her friends and subsequently, the petitioner came to know that the proposed accused has took the said cheque and filled up in her name and misused the same. Hence, the petitioner has lodged a complaint before the second respondent on 27.12.2017, but sofar, no action has been taken.

4.The learned Government Advocate (Crl.side) has submitted that after receipt of the complaint CSR.No.85 of 2018 was issued and enquiry has been conducted, during the enquiry, it was found that the proposed accused namely Chitra has filed a case against the petitioner herein for the offence punishable under Section 138 of Negotiable Instruments Act and considering the aforesaid facts, the said complaint was closed on 01.03.2018.

5.Recording the aforesaid submissions, this Criminal Original Petition is disposed of. It is open to the petitioner to avail any other remedy, which is available under the law. Sd/- Assistant Registrar(CS-II) /True Copy/ Sub Assistant Registrar To
