ORDER

The Criminal Original Petition has been filed under Section 439 (1)(b) of the Code of Criminal Procedure, to relax the condition imposed on the petitioner by the learned Special Judge (TNPID Cases), Madurai, in Cr.M.P.No.1887 of 2017, by order, dated 01.06.2017.

2. The petitioner is arrayed as accused in Crime No.7 of 2015 for the offences punishable under Sections 406, 420 and 120(B) of I.P.C., and Section 5 of TNPID Act, 1997, on the file of the respondent police. The learned Special Judge (TNPID Cases), Madurai, by order, dated 01.06.2017, in Cr.M.P.No.1887 of 2017 in Cr.M.P.No.3025 of 2016, granted bail to the petitioner that the petitioner shall appear before the Court concerned monthly once, i.e., on first working day of every month at 10.30 a.m. until the charge sheet filed. Hence, this petition has been filed to modify the said condition.

3. The learned counsel appearing for the petitioner submitted that the petitioner being a lady, complying the condition from 17.06.2017 without any deviation. Hence, the petitioner seeks modification of the said condition.

4.The learned Government Advocate (Criminal side) appearing for the respondent on instructions, would submit that the petitioner is complying with the condition without any deviation from 17.06.2017 to till date.

5. Considering the nature of offence committed by the petitioner and also considering the submission of the learned Government Advocate(Criminal side) that the petitioner is complying with the condition without any deviation from 17.06.2017 to till date, the condition already imposed on the petitioner is modified to the extent that the petitioner shall appear before the Court concerned, once in every two months, i.e., on every first working day of bimonthly at 10.30 a.m. until further order. The other conditions remain unaltered. Accordingly, this Criminal Original Petition is ordered.
