ORDER : The Court made the following order :- This Criminal Original Petition has been filed to cancel the bail granted to the 2nd respondent by the learned Principal Sessions Judge, Madurai vide order dated 15.09.2022 made in Crl.M.P.No.4975 of 2022 on the ground that the 2nd respondent again threatened the petitioner to withdraw the earlier complaint, which was filed by the petitioner on the allegation that her daughter committed suicide only due to the harassment made by the 2nd respondent. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.1791 of 2023 2.Initially, the First Information Report was registered for the offence under Section 174 Cr.P.C., in Crime No.450 of 2022, subsequently, it was altered into the offence under Section 306 IPC. It is the contention of the petitioner that after coming out of prison, the 2nd respondent is continuously threatening the petitioner in order to withdraw the earlier complaint.
3.The learned Government Advocate (Crl.Side) for the 1st respondent submitted that now, the investigation is completed and final report has also been filed before the learned Judicial Magistrate, Melur and the same has been taken cognizance in P.R.C.No.5 of 2023 and the same is also pending for committal. 4.In view of the aforestated facts, this Court finds no grounds to cancel the bail granted to the 2nd respondent. Therefore, this Criminal Original Petition stands dismissed.
