This Criminal Original Petition has been filed to direct the second respondent, to register a case based on the complaint given by the petitioner dated 08.01.2018.
2.Heard Mr.K.Sudalaiyandi, the learned counsel appearing for the petitioner and Mr.Prabu Ramachandran, the learned Government Advocate (Crl.Side) appearing for the respondents. 3.The learned counsel appearing for the petitioner has submitted that the petitioner is an NRI and working at Qatar and staying there with his family since 2005. He further submitted that with a view to manage his properties, he has executed a General Power of Attorney dated 01.08.2016, in favour of his own brother namely T.Thirumalaisamy and that being so the petitioner's own sister namely Ramalakshmi and her husband Jesu Maria Antony have created a unregistered forgery lease made over deed dated 25.03.2018, in respect of lease hold properties of 15 cents situated in Survey No.460, which belongs to Papanasam, Pillaian Arthasama Kattalai. facts, the petitioner has sent a complaint to the second respondent on 08.01.2018, but so far, no action has been taken. 4.The learned Government Advocate (Crl.side) has submitted that after receipt of the said complaint, CSR.No.19 of 2018, has been issued and enquiry has been conducted and after enquiry, the same was closed on 22.01.2018, as the dispute in civil in nature. 5.Recording the aforesaid submissions, this Criminal Original Petition is disposed of. It is open to the petitioner, to avail any other remedy which is available under the law.
