O R D E R

This writ petition has been filed challenging the impugned proceedings of the first respondent dated 07.02.2020 refusing promotion to the petitioner, on the ground that she has not passed the Office Manual Test (Departmental Examinations), which is a pre-requisite for the petitioner to get promotion.

2. At the time of filing of this writ petition, the petitioner was working as Accountant. It is now brought to the notice of this Court by the

learned counsel for the petitioner that subsequent to the filing of this writ petition, the petitioner has been promoted to the post of Sub Treasury Officer / Superintendent. However, he would submit that the said promotion has to be given effect from the date when the petitioner's juniors were promoted to the said post. Therefore, the petitioner seeks for a prayer that the promotion should be with retrospective effect from the date on which the petitioner's juniors were promoted and to include the petitioner's name in the panel of Accountants for promotion to the post of Sub Treasury Officer / Superintendent for the year 2018 - 2019.

Learned counsel for the petitioner, on instructions, would submit that the petitioner is also willing to give a fresh representation to the respondents for the aforementioned purpose and a direction may be issued by this Court to the respondents to consider the same on merits and in accordance with law, within a time frame to be fixed by this Court.

4. After recording the fact that the petitioner has been promoted to the post of Sub Treasury Officer / Superintendent subsequent to the filing of this writ petition, this writ petition is disposed of by directing the petitioner

to submit a representation to the second respondent within a period of two weeks from the date of receipt of a copy of this order seeking to give effect to her promotion to the post of Sub Treasury Officer / Superintendent with retrospective effect from the date on which her juniors were promoted and to include her name in the panel of Accountants for promotion to the post of Sub Treasury Officer / Superintendent for the year 2018 - 2019 with all monetary and service benefits and on receipt of such a representation within the stipulated time, the second respondent shall pass final orders on merits and in accordance with law on the said representation within a period of eight weeks thereafter. No costs. Consequently, connected miscellaneous petition is closed.
